Overview

EmeraldBabe.com takes copyright infringement seriously. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable international intellectual property law, we will respond swiftly to notices of alleged copyright infringement that are submitted in compliance with the process described below.

If you believe that content hosted on EmeraldBabe infringes upon your copyright, please submit a formal DMCA takedown notice to our designated agent using the contact details at the end of this page.

What Qualifies for a DMCA Takedown?

A valid DMCA notice can be submitted if:

  • Your copyrighted photos or images have been used in a profile without your authorisation.
  • Your original written content (descriptions, text) has been reproduced without permission.
  • Any other copyrighted material you own or control has been published on our platform without a valid licence.

DMCA notices cannot be used to remove non-infringing content or to censor legitimate competing speech. Abuse of the DMCA process may result in counter-notices and legal liability.

How to Submit a DMCA Takedown Notice

Your notice must include all of the following to be considered valid:

  • Your full legal name and contact information (email, phone, mailing address).
  • A description of the copyrighted work you claim has been infringed.
  • The specific URL(s) on EmeraldBabe.com where the infringing content appears.
  • A statement that you have a good-faith belief that the use of the content is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the owner.
  • Your physical or electronic signature.

Our Response Process

Upon receipt of a valid and complete DMCA notice, EmeraldBabe will:

  • Review the notice within 2 business days.
  • Remove or disable access to the allegedly infringing content promptly if the notice is valid.
  • Notify the advertiser who posted the content that it has been removed.
  • Provide the advertiser with the opportunity to submit a counter-notice if they believe the removal was in error.

Counter-Notification

If you are an advertiser and believe your content was removed in error, you may submit a counter-notification to [email protected]. The counter-notification must include:

  • Your full name and contact information.
  • Identification of the content that was removed and its location before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we may restore the content within 10-14 business days unless the original complainant provides evidence of legal action.

Repeat Infringers

EmeraldBabe has a zero-tolerance policy for repeat copyright infringement. Advertisers or users who are subject to multiple valid DMCA notices will have their accounts permanently terminated without refund.
